Refinancing and title
Legal work on a property you are keeping: new financing, a change of owner, or something registered against the title that needs dealing with.
Changing the financing or the ownership, without selling
Not every transaction involves a property changing hands. These four deal with the title and the charges registered against it while you keep the property.
Refinancing
New financing registered against a property you already own: title review, registration of the new charge, and discharge of the old one.
Title transfers
Adding or removing an owner, transfers between family members, survivorship applications, and changing how title is held.
Title issues
When something is registered against the property that should not be, or a closing is about to be held up by it.
Private lending
Acting for a private lender, or for a borrower, where the documents are negotiated rather than standard.
Land transfer tax on a transfer
A transfer between family members is not automatically free of land transfer tax, and the exemptions are narrower than people expect. Where a mortgage stays on the property, the calculation can change again.
It is worth asking before the transfer is arranged rather than afterwards, because the structure often determines whether an exemption applies at all.
